Looking for Joshua DENLEY (convict) and Charlotte MOORE from England, settled Tasmania and New South Wales, Australia

I've just started researching the DENLEY family on behalf of my brother-in-law.

Joshua (Josiah) DENLEY {AFN: 238P-WNR} See Monaro Pioneers was born abt 1822 England possibly Surrey area. He was a convict who was sentenced to 14 years transportation to Van Diemen's Land in 1832. After his sentenced expired he moved to New South Wales in 1846 and shortly after met and married in 1847 to Charlotte MOORE {AFN: 238P-WP0} who was born abt 1821 England, and came to Australia when she was about three years old. She was 19 years old when she married, I've not found the location yet. And died aged 46 years from an abscess of the liver on 28 Feb 1867 at Mt. Pleasant, near Myalla, New South Wales, Australia and was buried 2 Mar 1867 at Cooma NSW. Her Death Certificate states issue: 7 males and 4 females living, with 1 female and 1 male deceased. So records would seem to indicate that they had 12 children, though I haven't found them all yet.

Emigration details of Joshua DENLEY: From Charles Bateson's book "The Convict ship's". It was York 1 (3) third voyage, arrived 29/12/1832, Ship, 429 tons, Built at Southwick in 1819, Master Richard Spratley, Surgeon Jas. McTernan, Sailed 1/9/1839 from Plymouth, days 119. 200 male prisoners, landed 200 at Hobart, Tasmania, Australia.

More about the WRIGHTs: John WRIGHT Jr. was the son of John WRIGHT and Jane ATKINSON. John Wright (Sr.) was born in England about 1805 to 1807. He married Jane Atkinson and they migrated to Tasmania in 1834. From the "Hobart Town Courier" on 5 September 1834 - "arrived same day (4th) the bark "Edward", Capt. Lindsay, 406 tons, from Woolwich 5th May, with 157 female prisoners and 23 children, under the superintendence of Surgeon Sterritt, R.N., also 9 free women and children. passengers, Mr & Mrs. Wright, Mr. Slomer." Their son, William Edward, was born at sea on 16 June 1834. In 1835 John Wright tendered for a building operation on the Commissariat Offices (CSO 19/3 p.153). John Wright was shown as owning an allotment of 11 perches of corner of Colville and Sloane Streets in Sept. 1839 (SC 285/116). Two houses were built on this allotment. After John's death they were in the name of Miss Mary Wright. In 1868 the house on the corner of Sloane and Colville Streets was in the name of Ann Clinch and remained in her name and then in the name of her Estate until 1929. The house next door (now No .36) remained in the name of Mary Wright until 1926 after which it too was in the name of Ann Clinch's Estate. In 1930, both properties were in the name of E.H. McDevitt (Assessment Rolls, Hobart). John Wright died at his residence at Battery Point and was buried in St. David's Church of England Cemetery on 1 September 1863. Death Notice in "Mercurcy" 31/8/1863 - "On the 28th inst. at his residence, Battery Point, Mr John Wright, late builder of this city, after a long and painful illness, in the 58th year of his age. His friends are respectfully invited to attend his funeral, which will move from his late residence, on Tuesday, the 1st September, at half-past two o'clock." NOTE: Photocopy of Register of Deaths shows 29 Aug as date of death and 58 years as age.

Notes for John Wright Jr.:- Location - Browns Creek and Burtons road, west of Bridges. Selected by John Wright on 4 September 1893 as Selection No.A.F.2382. Deed of Grant to John Wright was prepared on 8 May 1899. About 1906 John retired back to Brisbane. He died in the Brisbane Hospital on 20 July 1916 and was buried in the Toowong Cemetery, Por 1, Sect 136, Lot 11/12., on 21 July 1916.

(3) Annie May Louise WRIGHT was definitely born at Battery Point, Tasmania, Australia although it is not yet known when, she could have been the couple's first born child, married 1890 Queensland, Australia {marriage reg.no.1890/B14400) to Edward SCHWEDE who could have been born 1856/1860 Riga, Latvia died abt 1912 Queensland, Australia, the son of possibly Frederick SCHWEDER and possibly Louise or Dora DIXON (verification required). Annie died 1919 Brisbane, Queensland, Australia (death reg.1919/C1906). She is supposedly buried at Toowong Cemetery, Cnr Frederick St and Mt Coot-tha Rd, Toowong, Queensland, Australia although I haven't found any records yet for SCHWEDE or WRIGHT.

CARRUTHERS family file: The Fatal Quarrel - James Henry LEGG 23 June 1892, Barraba / Manilla River NSW Australia

On a cold, frosty night on Thursday, 23rd June 1892, James Henry LEGG (carrier), brother of our ancestor Leah LEGG died in a tragic domestic dispute. He was killed by his wife at their house 8 miles from Barraba on the Manilla River. The report in the "Tamworth News" on Tuesday, June 28, 1892 began:-

"...Early on Friday morning last, the townspeople were startled with a report that James LEGG, a well known resident, had been killed during a quarrel with his wife and further enquiries proved the report to be true. The deceased, who was a powerful man, and his wife had never lived happily together and were constantly quarrelling. Except the eldest boy, no one so far is known witnessed the occurrence which took place at night and the statement of the boy at the inquest does not throw much light on the matter. It will be seen by the evidence that Mrs LEGG admitted doing the deed, the weapon used being a switch stick about three feet long and five or six inches in circumference..."

In the early hours of Friday 24th June Mrs Elizabeth Legg was charged with murder by Senior Constable JOHNSON at Plumthorpe Station where she had gone for assistance after a violent dispute with her husband. An inquest began on Saturday 25th June and was held before Mr Corbett Lawson and a jury comprised of James BOOTH, E.TURNER, J.ROSE, W.DOUGLAS, J.MCALPINE, S.LILLIS, H.SAUNDERS, B.CHAMBERS, A.WITTEN and A.CUTMORE. Accounts were heard from a variety of witnesses and Mrs LEGG herself. The jury returned a charge of manslaughter on Monday 27th June 1892. Five weeks later, on the 2nd August 1892, Mrs Legg was tried, apparently in Tamworth on this charge. Evidence was heard from witnesses including a Dr Loftus CAMPBELL, Senior Constable JOHNSON, Alfred James LEGG (son of Elizabeth and James), Cl ifford WILSON (part owner of Plumthorpe), and Alfred MARKWELL (overseer of Plumthorpe). It was revealed that James LEGG had a long record as a very cruel, violent man. Particular incidents which were revealed included his having tied his wife up behind a dray, inflicted severe injuries upon his young daughter, broken his brother-in-law's leg and having being gaoled for in Tamworth for acts of violence. He had been summoned and arrested a total of 23 times in the past eight years.

Most importantly the trial also revealed that Elizabeth LEGG had unintentionally killed James LEGG when defending herself against a knife attack.

In the final stage of the trial, the Judge stated "...I think with regard to all the circumstances of this case that it would be properly met by a nominal punishment it becomes lawful for me under the section I have been referred to, to discharge you without asking you return any verdict. And that operates as an acquital. I discharge you gentlemen (the jury) without you giving a verdict." ...Mrs Legg you are discharged".

Mrs Legg replied, "Thank you Sir".




Unconfirmed research indicates that Mrs Legg later moved to Bingara and raised her family there.

CARRUTHERS family file : The RUSSELL family home - Rocky Corner- including families LEGG and MATTHEWS

Dear members, Below is more miscellaneous data pertaining to the CARRUTHERS family... Whilst I am not researching these families, I am assisting others.


The Legg, Russell & Matthews families were among the first European settlers in the Tareela Run on the Manilla River & Hawkins Ck west of Barraba. Leah Legg acquired 100 acres as early as 1874 which was before she married Arthur Wellesley Russell. I appear that Arthur?s first land selections were not until about 1881. The Leggs, Russells and Matthews?s families purchased quite a number of blocks in the district. Inspection of an 1889 map of Parish of Belmore, County of Darling, Tamworth Land District shows a number of holdings, including a 400 acre block of AW Russell adjoining Mt Tareela and a 100 acre block in the name of Leah Legg, fronting the Manilla River. The same map shows at least 11 other blocks of land ranging in size from 60 to 300 acres in the title of Legg and Matthews.

The Russell family home was located on a 40 acre block of land called ?Rocky Corner?. This was located on the Trevalyn Road about 15 kilometers west of Barraba. It is now part of Bareela Station. The land fronts the Manilla River and is linked to the main road by a tree-lined laneway. Only the fireplace and a few foundation stumps remain of the original house. The family is not certain as to when it was built and where Arthur and Leah lived before then. A number of their children are recorded as having been born at Tareela, so perhaps they had a residence nearer Mt Tareela than the Rocky Corner house.

The block later referred to as ?Rocky Corner? was originally taken up by Leah?s brother, James Henry Legg on 5th July 1877. A sale of the block lapsed on 25th February, 1881. At the time of the sale, it had built on it a hut valued at 5 pounds. Alfred C Legg, James brother, bought the block on 27th July, 1877 however it was forfeited on 8th November, 1893. Leah Russell purchased the block on 12th March, 1896 but the purchase was disallowed on 3rd February, 1897. It was taken up by Arthur Wellesley Russell on 18th February, 1897. Following his death in 1914, the land again passed to Leah Russell who sold it to her son Arthur Wellesley Russell on 10th February, 1923. I was sold back to her on 15th July, 1925. Thereafter, Leah transferred the property to her youngest child Alice Eva Smith. (Alice married Percy Edward Smith in 1925). The transfer was in consideration for a rent charge of 10/- per week to be paid until her death. Alice entered into the following encumberance with her mother:-

?to pay weekly payments of 10/- on the Saturday of each week, the first such payment being due and payable on 10th November instant provided that the said Alice Eva Smith supplies the said Leah Russell with food to the same quality and quantity as she supplies at present. Such food shall be in full satisfaction of the said weekly payments in each week in which it is so supplied?. ??. Prepared by JB Ryan, solicitor in Barraba.
