Examination Of
Judgement Debtor
The affairs of Thomas Pink-stone Kelly, a judgement debtor, were examined in the
Magistrate's Court, before Mr
N. P. Applin, SM.
The examination was the
result of a previous action
brought by Kelly against his
wife, Amy Helena Kelly, for
the return of certain pro-
perty. A verdict had been
given against Kelly and he
was ordered to pay costs.
At the conclusion of the ex-
amination, no order was made
by the Court.
Mr D. E. Davey (Messrs
Rees R. and Sydney Jones)
appeared on behalf of Mrs
Kelly, and Mr J. Maloney (in-
structed by Mr A. D. Cooper)
for Kelly.
Examined by Mr Davey,
Kelly said he now resided at
123 Gladstone Road. He had
lived at 7 Margaret Street,
until he had been turned out
by his son a few weeks ago.
He was 68 years of age and
a retired railway employee,
but received no railway or old
age pension. Prior to receiving
£1500 from Golden Casket No.
1891, he had received the old
age pension.
The £1500 actually belonged
to Miss Mary Esther Bell, as
she had given him the money
to buy the ticket. The casket
was drawn on February 27 and
he had previously bought many
tickets for her in his own
name. The bank had paid the
money to him because the
ticket was in his name. He did
not know why the Common-
wealth Bank paid the money
to him in notes, as he had not
asked them to do so.
The money was won after
the hearing of the previous
case, and he knew that his
wife, who had left him In
August, had got an order
against him for costs.
Witness said he was living
temporarily with Miss Bell
and his bank account at pres-
ent was l/l. He owned no pro-
perty and had no income.
Mr Davey to Kelly: Will you
explain to the court how you
exist?-Up to the present I
have been kept by Miss Bell.
I work for her in repayment. I
am looking after her house
while she is in hospital and I
also work in the garden.
Zs there nobody else in the
bouse ? - No, just our two
selves.
Has Miss Ben any other
means of support besides this
£1500?--I think she has. I
look after all her business and
I am her financial adviser.
ELECTION EXPENSES
Kelly said be knew Miss Bell
invested £1400 of the casket
money in two banks, but he
had no control over the
money. He had sold a small
iron safe and other articles to
her and the money she paid
him was used for the purchase
of warm clothes and for ex-
penses in connexion with two
elections.
Mr Davey: Is lt not a fact
that the giving of the £1500
to Miss Bell is just so much
eyewash?-No. '
Haven't you been boasting
around town that you did this
to avoid payment of costs?
No. !
j Witness said his election ex-
penses had been over £200. He
had drawn £35 from his Sav-
ings Bank account In October
[and £20 in February for his
nomination fees. The £100 that
was not banked out of the
i Casket prize was Miss Bell's
land he received no part of it,
although he purchased the
ticket for her.
Previously he paid Miss Bell
£1 per fortnight for bis board,
but he was not paying any-
thing now. He was not legally
entitled to any of the. Casket
money and she was not a
trustee for him. There had
been nothing to prevent him
from saying that he had won
tiie money for himself, except
that he always told the truth.
Miss Bell was in ill health and
he had not wished her to give
evidence.
Mr Davey: Do you realise
that if this matter is taken
